This memo builds upon the analysis I originally published in February 2017 concerning produced water ownership in Texas. The issue was a topic of hot discussion last week at the Permian Basin Water in Energy Conference in Midland.
During the event, I promised the audience I would publish a detailed legal underpinning for the panel remarks I made.
